    The Percapita will continue!

    Tribal Members, keep in mind that both the Tribe and National Indian Gamming Commission has had four long years to deal with this issue but for some reason both have chose not to. For the NIGC to State that they were made aware of the percapita issue via a news article, demonstrates they must not be reviewing the AUDITS they have received over the past four years with regards to the amounts and method of distribution

    The Tribal Council for the past years have operated outside of tribal policies by granting waivers and special exemptions to themselves and select tribal members as mentioned in the NIGC notice of violation in the form of $25,000.00 down payment for a council member, loans to members and employees, early paychecks some to 15 ahead, $500.00 here and $500.00 there. It is this type of behavior that has finally caught up with us.

    As a tribe we need to establish priorities for the benefits we provide and help those members that really need the help (Elders, Children, lower Income, ect.) and if a program does not work then change it.

    Puyallup Tribe is violating Tribal and Federal laws regarding how it distributes the gaming revenue

    Puyallup Tribal members,
    On June 12, 2006, the Puyallup Tribe received a Notice of Violation from the National Indian Gaming Commission, (NIGC), a federal agency that the Puyallup Tribe is currently violating Tribal and Federal laws regarding how it distributes the gaming revenue. The Tribe revised its Revenue Allocation Code (RAC) in the year 2002 to fit the per capita, but then has not revised the Code within the past four years, to take into consideration as to how much is currently being distributed

    The NIGC points out that the Tribe is violating its own laws, because the Tribe had promised to have the new RAC in place, in order to conduct gaming. The easy fix, is to simply revise the Tribe's Revenue Code and bring it into compliance with the amounts the Tribe currently distributes and for future expansion revise the Code.

    But the NIGC has also expressed “ evidence of several other problems ”, in paragraph three of its letter to the Tribe, which states, “The investigation also revealed evidence of several other problems with the Tribe's use of net gaming revenues. First, we are concerned that the Tribe's various ad hoc distributions of net revenues to certain categories of tribal members may constitute additional per capita payments that exacerbate the over-allocation problem in Count 1 of the NOV. Second, we are concerned that the Tribe may be making non-interest loans and payroll advances funded largely by net gaming revenues that are not in compliance with an established tribal program, and are not being repaid to the Tribe, thus constituting a misallocation of net gaming revenues. Finally, we are concerned that the Tribe may be cashing-out unused annual leave for tribal officials and employees in violation of the Tribe's established annual leave policy, using funds that come largely from net gaming revenues, thus constituting a misallocation of net gaming revenues.”

    In order for the Tribe to continue to provide benefits to it's members, and it's members to receive benefits, we have to follow the laws, procedures, and guidelines that have been established by the Tribe. If the Tribe is to operate its government outside the guidelines or an absent thereof, clearly puts every and all of the Tribes assets at risk.

    In order to protect our future, this past behavior has to Stop, and Stop NOW!

    We as Tribal Members, need to support a Tribal Government that will uphold the laws, procedures, and guidelines, as well as hold all violators accountable.
